SOTG 151 – NC Racist Permit Law

Legislators in North Carolina have taken steps to remove the century old handgun permit law, a leftover from Jim Crow. Not surprisingly they are meeting with push back from those who do not want to surrender that power.

A Connecticut lawmaker wants to bribe citizens into surrendering their liberty. Offering her “expert” opinion that AR-15 rifles have no value for hunting or self-defense, this elitist is seeking more way to allow peasants to surrender to the state. Lastly, an ND in a Pennsylvania church offers us the opportunity to learn a lesson.

MOUNT AIRY, N.C. — Pistols permits could be eliminated altogether in North Carolina.

This is thanks to a House Bill 562, which would amend multiple firearm laws. However, one portion of it would do away with certain general statutes; those which apply to pistol permits.

“I really don’t think the people that sponsor this legislation have a lot of ill intent, I think the problem is that they don’t really understand the significance of what it is they’re trying to do,” said Surry County Sheriff Graham Atkinson.

Currently, to legally get a pistol in our state, you first need to apply for a permit with your local sheriff’s office. They would do a background check and decide if you’re eligible for a pistol permit. Then, you would go through another background check, this time, at the store selling you the pistol.

State Rep. George G. Cleveland, a primary sponsor of the bill, told FOX8 he believed this process is too redundant.

“The background check would be done at a federal level anyway, if we did not have the local sheriff, so there wouldn’t be any way possible for anything to get through,” said Jason Isaacs, owner of Gun Country in Mount Airy.

But sheriff’s offices in Forsyth, Yadkin, Surry and Wilkes counties all told FOX8 that’s not the case.

“The problem with that is that, the NICS (National Instant Criminal Background Check) system doesn’t include local assaults, including domestic assaults, which are an automatic disqualifier,” Atkinson said.

The NICS system is that which is used by store owners to do background checks on potential buyers.

Atkinson and several other sheriffs also argued that they know things on the local level that store owners would not be privy to.

“We know things about people that are not in a criminal record somewhere that may lead us to believe that right now is not the right time to be issuing a pistol permit,” said Atkinson. “Those are the kind of things that we may know on the local level, that a dealer would have no reason to know, and certainly a national database would not have in it.”

However, Isaac and some other local gun shop owners say the current process is too excessive; punishing the majority of would-be gun owners for the actions of few.

“We’re sinking the whole ship just because of one or two people,” Isaacs said. “Instead of the three day wait, they could just come in, find the firearm that they would like and we could do a federal level background check right there on the spot.”

Rep. Cleveland told FOX8 that, if the current version of the bill passes, the permits would be phased out over the next three years.

Gun owners would receive tax breaks for voluntarily turning in high-powered assault rifles under new legislation proposed Monday.

The Support Assault Firearm Elimination and Education of our (SAFER) Streets Act expected to be reintroduced next week by Rep. Rosa DeLauro (D-Conn.) would provide gun owners with an incentive to turn in their firearms to local police departments.

“Assault weapons are not about hunting, or even self-defense,” DeLauro said. “There is no reason on earth, other than to kill as many people as possible in as short a time as possible, that anyone needs a gun designed for a battlefield.”

Though DeLauro is in favor of stronger guns laws that would completely ban assault weapons and high-capacity ammunition, she emphasized this bill would not force gun owners to turn in their firearms.
The legislation would provide up to $2,000 in tax credits for gun owners who voluntarily hand over assault weapons to their local police departments.

The assault weapons legislation comes in response to the horrific mass shooting at Sandy Hook Elementary School in Newtown, Conn., DeLauro’s home state, in December 2012.

DeLauro originally introduced the bill in January 2013, just one month after the Newtown shooting, but the legislation fell short in the Republican-controlled House. She plans to reintroduce it next week when Congress returns from recess.

She said the bill would help “get more assault weapons off the streets.”

“Just days after the Newtown tragedy, President Obama asked, ‘Are we doing enough to protect our children?’ And he admitted the answer is, ‘no.’ That must change,” DeLauro said.

DeLauro is announcing the assault weapons legislation this week in conjunction with National Public Health Week.

As soon as Jason Wagler heard it, his instinct was to take cover.

The “it” was a gunshot at the Cathedral of the Blessed Sacrament in Altoona, Pennsylvania, on Saturday. See, according to WTAE-TV, a man was standing up during an Easter vigil service when a gun in his pocket went off, the bullet grazing his hand and smoke filling the area. The Altoona Mirror reported officer Christy Heck said the safety was “apparently not engaged.”

It should be noted that not all guns have “safeties,” but the officer seemed to be under the impression that the firearm in this case did have one.

While that alone is enough of a lesson in gun safety, what Wagler said he captured with his camera after isn’t much better.

“I noticed the gun was handed to another gentleman. He immediately concealed it in a white program, so I took pictures of the gun inside this program,” Wagler told WTAE.
